Terms of Service
These Terms govern your access to and use of Stradiva, including the platform, the website, the documentation, the CLI, and any other Stradiva-provided service ("the Service"). By using the Service, you agree to these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. All references to "you" include both the individual and the organization.
1. Your account You are responsible for safeguarding your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
2. Acceptable use You may not use the Service in any manner that interferes with normal operation, attempts to gain unauthorized access, transmits malware, or violates applicable law. You may not benchmark the Service or its competitors without our written consent.
3. Customer data You retain all rights to the data you submit to the Service. We process your data only as needed to provide the Service, as described in our Data Processing Addendum (DPA).
4. Fees and billing Fees are described in your order or on the pricing page in effect when you signed up. Fees are non-refundable except where required by law.
5. Term and termination These Terms remain in effect until terminated by you or by us with reasonable notice. We may suspend access for material breach or for activity that endangers the Service.
6. Disclaimers The Service is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied.
7. Limitation of liability Our aggregate liability under these Terms shall not exceed the fees paid to us in the twelve months preceding the event giving rise to the claim.
8. Governing law These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in New Castle County, Delaware.
Privacy Policy
This Privacy Policy describes how Stradiva collects, uses, and discloses information.
What we collect We collect: (a) information you provide directly — account details, billing information, support requests; (b) information collected automatically — log files, device information, analytics events; and (c) information from third parties — identity providers, payment processors.
How we use it We use the information to provide and improve the Service, to communicate with you, to comply with legal obligations, and to investigate misuse.
How we share it We share information only with: service providers acting on our instructions; entities involved in a corporate transaction; and as required by law.
Your rights Depending on your jurisdiction, you may have rights to access, correct, delete, or port your information. To exercise these rights, contact privacy@stradiva.dev.
International transfers Data may be processed outside of your country. We rely on Standard Contractual Clauses and equivalent mechanisms for international transfers.
Retention We retain information for as long as needed to provide the Service and to comply with legal obligations. Specific retention periods are described in our DPA.
Data Processing Addendum
This DPA forms part of the Terms when Stradiva processes personal data on behalf of customers subject to applicable data protection laws.
